EVENT RULES

By registering for this event, you are deemed to have agreed to these rules.  They are devised both for your own safety and for the well being of the event as a whole.

The Poppyscotland Hearts & Heroes Challenge is being organised by Poppyscotland and Hearts & Balls alongside WildFox Events Ltd, which specialises in fundraising fitness challenge events. WildFox Events Ltd is being employed to manage the event on behalf of Poppyscotland.  Their staff will be available to present to companies and organisations interested in participating, and to answer any questions about the event.

By registering to take part in The Poppyscotland Hearts & Heroes Challenge you are agreeing to the following conditions of entry and to any instructions given to you by the organisers, officials and marshals before, during or after the event.

Entry and Registration

You and your team members must be at least 16 years of age on 15th May 2010.  We may seek proof of age evidence.

The Poppyscotland Hearts & Heroes Challenge is a team event and each team must include a minimum of four (4) individuals.

You and your team members will pay The Poppyscotland Hearts & Heroes Challenge a non-refundable registration fee of £50 per entrant.  Your place is not secured until this fee is received from you and an additional three (3+) team members (deadline 16 Apr 2010). If, however, The Poppyscotland Hearts & Heroes Challenge is fully subscribed on receipt of your fee, you will be entitled to a refund.

You and each team member will endeavour to raise at least the minimum sponsorship requirement of £400 each. You and your team members will send all of the sponsorship money, which you have raised, to Poppyscotland as soon as possible after the event ends but no later than 30th August 2010.  Sponsorship can be paid in via your online fundraising page or cheques should be made payable to Poppyscotland and sent to New Haig House, Logie Green Road, Edinburgh, EH7 4HR. Please remember the significant difference Giftaid makes and have sponsors give the required details wherever possible to enable Poppyscotland to claim it.

You and your team members are responsible for ensuring that you have the appropriate level of fitness to participate in The Poppyscotland Hearts & Heroes Challenge (all entrants are strongly advised to consult a doctor before undertaking any strenuous training programme, or participating in the event, should you believe there are grounds for such consultation).

You and your team members are taking part in The Poppyscotland Hearts & Heroes Challenge at your own risk. The organisers will have no responsibility for any risk, loss or costs which you incur in connection with the event and you will indemnify the organisers and any persons acting on their behalf for any risk, damages, loss or costs arising as a result of your participation in the event.

The organisers will not carry insurance in relation to your participation in the event so it is your responsibility to obtain any necessary insurance in connection with The Poppyscotland Hearts & Heroes Challenge.

Once accepted, your place cannot be cancelled unless we receive your written request to do so, nor can your place be transferred to any other person as this a serious breach of health and safety regulations, unless, in both cases, we receive written notice of the change 24 hours prior to the registration deadline, 16 April 2010.

Please check that you enter the correct information. Registration details can be amended online up to the registration deadline, 16 April 2010.

Participants with disabilities are welcome to take part, although due to the nature of the event we ask you to contact the organisers prior to filling in this form.  The event’s terrain is not suitable for wheelchair access.

If a disabled person requires assistance from another person, this person must also enter The Poppyscotland Hearts & Heroes Challenge as a participant.

Event Participation

Prior to and during the event you and your team members will be responsible for your own safety.  You will take all reasonable care to ensure the safety of other participants and you will comply promptly with all instructions and guidelines given by the organisers and any persons acting on their behalf.

You must not deviate from the official route which will be marked by The Poppyscotland Hearts & Heroes Challenge signage from start to finish. Signs will also indicate when you are approaching a refreshment stop.  The organisers will not accept responsibility for the loss or damage of any event signage where its loss is out of their control.  They will however take all reasonable steps to replace missing or damaged signage.

There will be marshals located on the route and all volunteers and staff involved in the event will be clearly identifiable. The marshals are there for the safety of you and other route users. You will listen and obey their instructions.

All teams will be given an event identifier either prior to or at event check-in, which must be displayed for identification at checkpoints and is your passport to refreshments on the course.
The organisers reserve the right to terminate an individual's attempt to complete the event on health and safety grounds.

The Poppyscotland Hearts & Heroes Challenge will take place regardless of bad weather and will only be cancelled, re-routed or stopped for reasons of safety or by law.  Refunds will only be made in the event that The Poppyscotland Hearts & Heroes Challenge is unavoidably cancelled by the organisers.

You must complete the course within 12 hours to be classified as a finisher.

Team entries will only be deemed as having completed the course when the last member of the team has crossed the finish line, upon which the official finishing time for the team entry will be based.

Neither WildFox Events, the charities benefiting from The Poppyscotland Hearts & Heroes Challenge nor the Challenge sponsors accept any liability for the health of the entrant, before during or after the event.

For reasons of safety, no entries will be allowed unless participants are walking or running only.

Given the existence of farms along the route, and the coincidence of our event with the lambing season, dogs may only accompany blind participants, and must remain on a leash at all times.

There may be limited changing facilities at the event start. You are advised to come ready and dressed appropriately for the event.

The organisers will have no responsibility for damage to vehicles or property left within vehicles.

On NO account is alcohol to be brought onto the course by participants, or to be consumed prior to or during The Poppyscotland Hearts & Heroes Challenge.  Only alcohol purchased at the post Challenge event at The Greenyards may be consumed there.

By completing this entry process you are agreeing to follow the reasonable directions of the organisers and abide by the rules of The Poppyscotland Hearts & Heroes Challenge which shall be communicated to you from time to time.

Fundraising and Sponsorship

IMPORTANT: By taking part in The Poppyscotland Hearts & Heroes Challenge you are committing to raising money for the agreed charities only.  Any fundraising undertaken in the name of the Poppyscotland Hearts and Heroes Challenge must not be donated to any charity other than those benefiting from the Poppyscotland Hearts and Heroes Challenge.

You are not permitted to use any of the sponsor money that you raise in relation to The Poppyscotland Hearts & Heroes Challenge to pay for your expenses.  If you do not pass all of the money that you raise to The Poppyscotland Hearts & Heroes Challenge you may be deemed, within a court of law, to be committing a criminal offence.

Entry fee cheques should be made payable to Poppyscotland and sent to New Haig House, Logie Green Road, Edinburgh, EH7 4HR.

Sponsorship cheques should be made payable to Poppyscotland and sent to New Haig House, Logie Green Road, Edinburgh, EH7 4HR.

Photographs will be taken at the event and may be used by the sponsors of the event, the media, Borders Council, Tigershark Ltd, WildFox Events Ltd, Poppyscotland and Hearts & Balls for the purpose of marketing/PR.

Data Protection

By registering for this event you agree that WildFox Events Ltd, Poppyscotland and Hearts & Balls may contact you in the run up to this event with important participant information.

Administration for this event is provided by WildFox Events Ltd, Kindrochit House, Ardtalnaig, By Aberfeldy, Perthshire, PH15 2HX and Poppyscotland, New Haig House, Logie Green Road, Edinburgh, EH7 4HR. Data collected from this event will be passed to WildFox Events Ltd and Poppyscotland for the purpose of administration only, unless further permissions have been granted.

In the course of registering and participating in The Poppyscotland Hearts and Heroes Challenge we will collect personal data from you, your team members and your support members. We may process and use the personal data collected for administrative, research and publicity purposes. By entering the event you give us permission to use your name (and that of your team, team members and organisation that you represent), voice or picture in any broadcast, telecast, advertising material, or other account of The Poppyscotland Hearts and Heroes Challenge.  We may also pass your details to any agents who may contact you solely for promotional purposes.  Please note that these terms do not apply to medical data; that which is regarded as medical data is clearly distinguished as such on the registration form.  Medical data is held in the strictest privacy and never shared with anyone.

The benefiting charities may also use your details to send you information about future events which we think may be of interest to you. You are entitled to request access to, and correction of, all of your personal data collected by us, as well as requiring us to delete your data if you no longer wish us to process it after having taken part in The Poppyscotland Hearts and Heroes Challenge.
